About the Credit Repair Organizations Act (CROA)

The Credit Repair Organizations Act (15 U.S.C. §1679 et seq.) is a federal law that regulates companies offering credit repair services. It was enacted to protect consumers from deceptive or abusive practices and to ensure transparency in the credit repair industry. CreditGM fully complies with all CROA requirements.

Your Rights as a Consumer Under CROA

Under CROA, you have the following rights:

  • Right to Cancel: You may cancel your service agreement with any credit repair organization within three (3) business days of signing — for any reason — without penalty or obligation.
  • Right to a Written Contract: You must receive a written contract before services begin. The contract must clearly describe the services to be performed, the total cost, and the timeframe for completion.
  • Right to Accurate Information: Credit repair organizations are prohibited from making false statements about your credit or their services.
  • Right to Sue: If a credit repair organization violates CROA, you have the right to sue and may recover actual damages, punitive damages, and attorney's fees.
  • Right to Report Violations: You may report violations to your state attorney general or the Federal Trade Commission at ftc.gov.
  • Prohibition on Advance Fees: Credit repair organizations may not charge or collect any fees before services are fully performed.

What Credit Repair Organizations Cannot Do

Under CROA, a credit repair organization may not:

  • Make false or misleading statements about your credit file or their services
  • Advise you to make false statements to credit bureaus or creditors
  • Advise you to change your identity to create a new credit file (e.g., using a CPN)
  • Charge fees in advance of completing the agreed-upon services
  • Claim to remove accurate, timely information from your credit report

Your Rights Under FCRA

The Fair Credit Reporting Act (FCRA) gives you additional rights, including:

  • The right to one free credit report per year from each bureau at AnnualCreditReport.com
  • The right to dispute inaccurate or incomplete information directly with the bureaus
  • The right to have disputes investigated within 30 days
  • The right to have inaccurate information corrected or removed
  • The right to know when your credit file has been used against you
